{"id":59,"date":"2022-05-30T15:47:00","date_gmt":"2022-05-30T18:47:00","guid":{"rendered":"https:\/\/wambier.com.br\/novo\/?p=59"},"modified":"2022-05-30T15:47:01","modified_gmt":"2022-05-30T18:47:01","slug":"novo-marco-legal-do-transporte-ferroviario","status":"publish","type":"post","link":"https:\/\/wambier.com.br\/novo\/novo-marco-legal-do-transporte-ferroviario\/","title":{"rendered":"\u00a0Novo Marco Legal do Transporte Ferrovi\u00e1rio"},"content":{"rendered":"\n<p>No \u00faltimo dia 23\/12\/2021, o Presidente sancionou a Lei n\u00ba 14.273\/2021, que institui o Novo Marco Legal do Transporte Ferrovi\u00e1rio, com vias a \u201cfacilitar investimentos privados na constru\u00e7\u00e3o de ferrovias, no aproveitamento de trechos ociosos e na presta\u00e7\u00e3o do servi\u00e7o de transporte ferrovi\u00e1rio\u201d.<br>Dentre as principais inova\u00e7\u00f5es, destaca-se: (a) a permiss\u00e3o para constru\u00e7\u00e3o de novas ferrovias por interm\u00e9dio de autoriza\u00e7\u00e3o, o que \u00e9 comum em outros setores de infraestrutura; (b) a facilita\u00e7\u00e3o para devolu\u00e7\u00e3o de trechos que n\u00e3o sejam mais de interesse do atual concession\u00e1rio, mediante disponibiliza\u00e7\u00e3o, via autoriza\u00e7\u00e3o, para terceiros interessados em assumir a explora\u00e7\u00e3o; (c) a possibilidade de que as operadoras ferrovi\u00e1rias se associem voluntariamente para promover autorregula\u00e7\u00e3o.<br>A san\u00e7\u00e3o, contudo, contou com dois relevantes vetos. Restou vetada a exig\u00eancia de documentos reputados como n\u00e3o essenciais \u00e0 obten\u00e7\u00e3o das autoriza\u00e7\u00f5es para explora\u00e7\u00e3o.
